The Register of Deeds is an elected official who is required by the laws of the State of Kansas to record all documents submitted by the public which meet the filing requirements. They maintain an up-to-date and accurate set of indexes which shows ownership of the property in Sherman County. The Register of Deeds office is responsible for filing deeds, mortgages, liens, oil & gas leases, plats of additions to the cities, Military discharge records, UCC’s and various other documents. All records in the Register of Deeds office are open to the public, except Military discharges and sales validation questionnaires. The Register of Deeds office is open Monday-Friday from 8:00 AM – 12:00 PM & 1:00 PM – 5:00 PM.

 

 

If the name or names of any signer or notary public are not plainly typed or printed under the signatures, the Register of Deeds shall charge and collect a fee of $1.00 in addition to all other fees provided in this schedule.  K.S.A. 28-115(d) If sufficient space is not provided for the necessary recording information and certification on a document, such information shall be placed on an additional sheet and such sheet shall be counted as a page. The document shall be of sufficient legibility to produce a clear and legible reproduction.  If a document is judged not to be of sufficient legibility, such document shall be accompanied by and exact copy thereof which shall be of sufficient legibility to produce a clear and legible reproduction and which shall be recorded contemporaneously with the document and shall be counted as additional pages.  The Register of Deeds may reject any document which is not of sufficient legibility. *No fee shall be charged or collected for any filing made by the secretary of health and environment or the secretary’s designee pursuant to K.S.A. 28-115(c).  If it is unclear that the person requesting filing is the designee, standard filing fees shall be collected. *FIXTURE FILING real estate mortgages are also subject to mortgage registration fees provided for in K.S.A. 28-115.

 

Recording Requirements

Documents presented for recording must be signed, dated, and notarized and be an original.  They must be of sufficient legibility with a font size of 8 or larger.  Documents must have a complete legal description.  All deeds that are recorded must have the name and address for mailing of tax statements.  The correct filing fees must accompany the documents before they will be recorded.  A space of 2 inches at the top or bottom must be left open for recording information.  A self-addressed stamped envelope is not required but is very much appreciated for returning documents.  If I have missed anything and you have questions please call the office.
